Toboase Family Secures Interlocutory Injunction On Okponglo Lands

The High Court in Accra has granted an Interlocutory Injunction filed over Okponglo lands, restraining the La Traditional Council and Joseph Mensah Ashong Petterson from entering and developing the land in dispute pending the final determination of the suit.

The Court presided over the matter involving Nii Sowah Ako-Odoi and Anor, Regents of Okponglo and lawful Representatives of the Nii Odoi Atsem Family of La and Okponglo and Nii Mensah Nyekpe-Enehu, Lawful Representative of Nii Ako Toboase Family for an Interlocutory Injunction against the La Traditional Council and Joseph Mensah Ashong Petterson (Defendants/Respondents), Justice Emmanuel Amo Yartey indicated that “Upon reading the affidavit of Nii Sowah Ako Odoi, the Plaintiff/Applicant filed on the 25th day of August 2020, in support of Motion on Notice for an Order for Interlocutory Injunction and Affidavit in Opposition of Joseph Mensah Ashong Petterson, Defendant/Deponent filled on the 2nd day of September, 2020. And upon hearing the submissions of Kwame Fosu Gyeabour Esq. Counsel for and on behalf of the Plaintiffs/Applicants. It is hereby ordered that the Defendants, their agents, assigns, officers, workmen, privies, servants, independent contractors, members or any persons claiming through them are restrained from entering, clearing, developing or interfering in any manner of the subject matter in dispute pending the final determination of the suit.

The ruling has thus halted the Defendants who have over the years alleged to be unlawfully developing the Okponglo lands from further developing the land until the final determination of the case which is pending in Court.
