Nii Nuertey Amobi II Remains Legitimate Chief Of Appolonia – Lawyers Declare

Legal representatives for the Appolonia Stool in the Kpone Traditional Area within the Kpone-Katamanso Municipality in the Greater Accra Region, led by the Chief of Appolonia, Nii Nuertey Amobi II, have issued a statement to address recent false reports concerning the status of the Appolonia chief.

Since Friday, July 5, 2024, several media outlets, including electronic, print, and social media platforms, have published claims that the High Court, Accra Human Rights Division Court 1, has ruled to destool the current occupant of the Appolonia Stool, rendering the position vacant.

According to the lawyers, these reports are categorically false and have been labelled as malicious, cruel, and mischievous by the legal team.

The lawyers emphasized that, under the Chieftaincy Act, 2008 (Act 759) section 78, and the Courts Act, 1993 (Act 459) section 17, the High Court does not have jurisdiction over chieftaincy matters, including the destoolment or status of chiefs.

Such matters, they said, are reserved for the judicial committees of the Chieftaincy institutions, specifically the Traditional Councils, Regional Houses of Chiefs, and the National House of Chiefs.

“Only the Supreme Court has appellate jurisdiction over chieftaincy matters on appeal from the Judicial Committee of the National House of Chiefs. To date, neither the High Court, Human Rights Division, nor any other court in Ghana has issued a ruling destooling the current Chief of Appolonia.”

They cautioned the public to disregard the false reports and treat them with the contempt they deserve and averred that Nii Nuertey Amobi II remains the legitimate Chief and occupant of the Appolonia Stool, continuing to perform his duties without interruption.
